Terms and Conditions

Two parts: the terms for buying from the shop, and the terms covering the DailyU app and this site.

Buying from the shop

These cover illustration packs, single-artwork licences and commissions.

What you are buying

An illustration pack is a licence to use the artwork, not ownership of it. The copyright stays with Bhavya Doshi. What you receive is a permanent, worldwide, non-exclusive right to use the drawings under the DoodleDesk Artwork Licence, which is published in full on this site and forms part of these terms.

The licence is granted to one person, or to one company. A company licence covers everyone working for that company; it does not extend to a parent company, a subsidiary, or a separate legal entity, and it cannot be passed to someone else without our written agreement.

Prices and tax

Prices are quoted in US dollars. Where a price is shown at checkout, that is the price you pay. Where the site asks you to enquire instead, we will quote in writing before anything is due, and that quote holds for thirty days.

Sales tax, VAT or GST is added at checkout where the law of your country requires it. Our payment provider acts as merchant of record for digital sales, which means it collects and remits that tax on our behalf; your receipt comes from them and shows the breakdown.

We may change prices at any time. A change never affects an order already placed.

Delivery

Everything sold here is a digital file. There is nothing to ship and no delivery address to give us.

When your payment clears, we email a download link to the address on the order. The link works for 72 hours. If it expires before you get to it, reply to that email and we will send a fresh one — your purchase does not expire, only the link.

If the email has not arrived within an hour, check the spam folder first, then write to us. Nothing is lost: every paid order is recorded whether or not the email reached you.

Refunds

The packs are files. Once they are downloaded they cannot be returned, so a purchase is not refundable simply because you changed your mind.

We will refund you in full, and without argument, if the download fails and we cannot fix it, if the files are corrupt or unusable, or if the pack is materially not what this site described. Write to us within fourteen days of the purchase and tell us what went wrong.

Where the law where you live gives you a right to cancel a digital purchase, that right stands and nothing here removes it. By downloading the files you agree that delivery has begun, which in some countries ends the cancellation window — that is the trade for getting the files immediately.

What we promise

The artwork is original work by Bhavya Doshi, and we have the right to license it to you. Every file has been checked before it goes into a pack.

Beyond that, the files are provided as they are. We do not promise that a particular drawing suits a particular project, that the packs will be free of every defect, or that a specific piece of software will open them the way you expect. Our total liability under these terms is limited to what you paid.

We do not sell the same artwork exclusively to anyone unless the agreement says so in writing. Assume someone else may license the same drawing.

Commissions and custom work

Commissioned work is quoted individually and governed by the brief we agree in writing, which takes precedence over these terms where the two differ. A commission normally requires a deposit before work starts, and the licence to the finished artwork transfers when the balance is paid.

If something goes wrong

Write to us first. Most problems are a download link or a file, and both are quick to fix. We answer within a day.

These terms are governed by the laws of India, and the courts of Mumbai have exclusive jurisdiction over any dispute arising from them. That does not take away any right you have under the consumer law of the country you live in.

What you may and may not do with the artwork itself is set out separately in the DoodleDesk Artwork Licence, which forms part of these terms.

The DailyU app and this site

Effective 7 February 2022.

By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights, and other intellectual property rights related to it, still belong to DOODELDESK Private Limited.

DOODELDESK Private Limited is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.

The DOODLEDESK, TDD app stores and processes personal data that you have provided to us, to provide our Service. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the DOODLEDESK, TDD app won’t work properly or at all.

The app does use third-party services that declare their Terms and Conditions.

You should be aware that there are certain things that DOODELDESK Private Limited will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider, but DOODELDESK Private Limited cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

If you’re using the app outside of an area with Wi-Fi, you should remember that the terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third-party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

Along the same lines, DOODELDESK Private Limited cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, DOODELDESK Private Limited cannot accept responsibility.

With respect to DOODELDESK Private Limited’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. DOODELDESK Private Limited accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.

At some point, we may wish to update the app. The app is currently available on Android, iOS & KaiOS – the requirements for the system(and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. DOODELDESK Private Limited does not promise that it will always update the app so that it is relevant to you and/or works with the Android, iOS & KaiOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.

Changes to This Terms and Conditions

We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page.
